利用規約 / Terms and Conditions

本規約は、当ウェブサイトの利用者であるあなたと、当ウェブサイトの所有者であるFlightScope Japan株式会社との間に適用されます。本規約の第1条、第2条、第4条～第11条、第15条～第25条への同意は、ユーザーが当サイトを最初に利用した時点で成立するものとします。第3条および第12条～第14条は、サービスの販売にのみ適用されます。本規約に拘束されることに同意されない場合は、当ウェブサイトのご利用を直ちに中止してください。本ウェブサイトのいかなる部分も、受諾可能な契約上の申し出を構成することを意図したものではありません。お客様の注文は契約上の申し出を構成し、当社がその申し出を受理したことは、お客様の注文が受理されたことを示す確認メールを当社がお客様に送信した時点で発生したとみなされます。

This agreement applies as between you, the User of this Website and FlightScope Japan株式会社, the owner(s) of this Website. Your agreement to comply with and be bound by Clauses 1, 2, 4 – 11 and 15 – 25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 3 and 12 – 14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

In this Agreement the following terms shall have the following meanings:
"Account": means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on the Website;
"Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
"Facilities": means collectively any online facilities, tools, services or information that FlightScope Japan株式会社 makes available through the Website either now or in the future;

Please be aware that orders or payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying Us of the unauthorised nature of the order or payment then you shall be charged for the period from the commencement of the provision of services until the date you notified us and may be charged for a billing cycle of one month.

  • 11.1 Either FlightScope Japan株式会社 or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.
  • 11.2 If We terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

  • 12.5 In the event that prices are changed during the period between an order being placed for Services and Us processing that order and taking payment, then the price that was valid at the time of the order shall be used.

  • 13.2.4 User credentials and relevant information for accessing those services.

  • 13.4 本サービスの支払いは、お客様が選択した支払方法により、お客様が購入したサービスプランに対応するセットアップ料金については直ちに、前月に発生した料金については翌月（「請求サイクル」）の同日に、またはお客様が受け取った注文確認書に記載されたとおりに行われるものとします。
  • 13.5 当社は、例外的な状況を除き、お客様の注文を2～3営業日以内に処理すること、または処理できない場合は、お客様の注文から合理的な期間内に処理することを目指します。合理的な期間内に注文を処理できない場合、当社は、お客様が注文を行う際に、関連するウェブページに記載するか、またはお客様が注文を行った後に直接お客様に連絡することにより、お客様にその旨を通知します。本契約の本質は時間ではありません。つまり、当社は合意された期間内にお客様の注文を履行することを目指しますが、これは本契約の必須条件ではなく、当社が履行しなかった場合、当社はお客様に対して責任を負わないものとします。当社がお客様の注文を受理してから14暦日以内にサービスを開始する場合、お客様の明示的な要求により、お客様は、以下の第14条に詳述するお客様の法定キャンセル権が影響を受けることを明示的に承認する必要があります。
  • 13.6 FlightScope Japan株式会社 は、最善の取引慣行に見合った合理的なスキルと注意をもって、本サービスを提供するために、当社のあらゆる合理的な努力を払うものとします。
  • 13.7 サービスが注文と一致せず、不正確に提供された場合、お客様は直ちに当社にその旨を連絡する必要があります。当社は、必要な修正が5営業日以内に行われるようにします。
    特定のサービスの提供には、追加の条件が適用される場合があります。お客様は、注文を完了する際に、かかる条件を読み、同意することを確認するよう求められます。
  • 13.8 FlightScope Japan株式会社は、オンラインサポートフォーラムおよび/または電話による技術サポートを提供します。FlightScope Japan株式会社は、適時に対応するために可能な限りの努力をしますが、特定の対応時間を保証するものではありません。

  • 13.1 Nothing on this website constitutes an acceptable contractual offer. Your order constitutes a contractual offer which we may accept at our sole discretion. Our acceptance will be indicated by sending you an order confirmation email. A binding contract between FlightScope Japan株式会社 and you shall be deemed to exist when we send you an order confirmation email.
  • 13.2 The Order Confirmation pursuant to Section 13.1 shall be sent to You prior to the commencement of Services and shall contain the following information
  • 13.3 If We, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, any sums paid by you in relation to that order will be refunded within 14 calendar days.
  • 13.4 Payment for the Services shall be taken via your chosen payment method, immediately for any setup fee that corresponds to the service plan you purchased and at the same day of each subsequent month (“billing cycle”) for charges accrued during the previous month (“billing cycle”) AND/OR as indicated in the order confirmation you received.
  • 13.5 We aim to fulfill your Order within 2-3 working days or if not, within a reasonable period following your Order, unless there are exceptional circumstances. If we cannot fulfill your Order within a reasonable period, we will inform you at the time you place the Order by a note on the relevant web page or by contacting you directly after you place your Order. Time is not of the essence of the Contract, which means we will aim to fulfill your Order within any agreed timescales but this is not an essential term of the Contract and we will not be liable to you if we do not do so. If the Services are to begin within 14 calendar days of Our acceptance of your order, at your express request, you will be required to expressly acknowledge that your statutory cancellation rights, detailed below in Clause 14, will be affected.

You may cancel an Order that we have accepted or cancel the Contract. The amount due shall be calculated in proportion to the full price of the Services and the actual Services already provided.   • 24.1 すべての通知／連絡は、当校の施設（上記住所参照）へ郵送するか、sales@flightscope.co.jpへ電子メールを送信することにより行うものとします。このような通知は、第一種郵便で送られた場合は郵送から3日後、営業日に電子メールを完全に受信した場合は送信日、週末や祝日に電子メールを送信した場合は翌営業日に受領されたとみなされます。
  • 24.2 当社は、お客様が受信を希望される場合、当社の製品および/またはサービスに関する情報を随時送信することがあります。このような情報の受信を希望しない場合は、当社から受信した電子メールにある「配信停止」リンクをクリックしてください。
